4.3 Refunds
Purchases made through Apple are generally governed by Apple’s policies, and refund requests (if any) are handled by Apple. Website purchases, business products, reports, usage packages, and other paid services are handled under the checkout terms, order form, or purchase terms shown at the time of purchase, unless required otherwise by law.
5) AI-Generated Output, Reports, and Decision Intelligence
Some outputs may be generated, assisted, summarized, ranked, classified, or analyzed by artificial intelligence or automated systems. Outputs may contain errors, omissions, outdated information, incomplete context, inaccurate classifications, or interpretations that may change as new information becomes available.
FactHub may provide reports, intelligence, audience signals, reaction analysis, behavioral patterns, Crowd Map results, debate signals, public-opinion indicators, market-reaction indicators, and other decision-support materials. These outputs are designed to assist your evaluation of a product, message, campaign, policy, price, investment thesis, brand decision, public communication, or other decision. They are not guarantees, instructions, professional advice, predictions of future performance, promises of market outcome, or substitutes for your own independent judgment.
You remain solely responsible for your final decisions and results. Any action you take based on FactHub outputs, reports, intelligence, recommendations, summaries, signals, or analysis is your own decision. FactHub does not assume responsibility for business, financial, legal, operational, reputational, political, product, campaign, market, or other outcomes that result from your use of the Services.
FactHub does not provide investment, legal, medical, tax, accounting, employment, regulatory, or other professional advice. If you need professional advice, consult a qualified professional before making decisions.
6) No Guarantee of Outcome
FactHub may identify risks, opportunities, audience segments, objections, behavior patterns, trust signals, confusion signals, resistance points, or potential improvements. However, real-world outcomes depend on many factors outside our control, including your implementation, market conditions, consumer behavior, timing, competition, pricing, distribution, public events, media coverage, platform changes, laws, and other external variables.
We do not guarantee that any product, campaign, message, policy, price, report, recommendation, or decision will succeed, avoid backlash, generate revenue, increase trust, reduce risk, change public opinion, or produce any specific result.
7) Acceptable Use
You agree not to:
- Use the Services for illegal, harmful, or deceptive activities
- Attempt to reverse engineer, scrape, disrupt, overload, or interfere with the Services
- Attempt unauthorized access to accounts, systems, models, prompts, reports, datasets, infrastructure, or data
- Upload, submit, or share content that infringes rights, violates privacy, or is unlawful
- Post, submit, or share objectionable, abusive, hateful, harassing, threatening, sexually explicit, exploitative, violent, spam, scam, or otherwise harmful content
- Impersonate another person, mislead users, manipulate signals, or repeatedly target other users with unwanted contact
- Use the Services to generate, test, distribute, or optimize unlawful, discriminatory, fraudulent, deceptive, or harmful campaigns, products, messages, or decisions
- Use automated tools, bots, scripts, or coordinated activity to distort votes, comments, reactions, Crowd Map data, debate activity, or other platform signals
8) User Content & Community Standards
If the Services allow you to submit content (“User Content”), including comments, replies, questions, votes, reactions, profile information, live chat, business testing inputs, survey-like prompts, product descriptions, campaign materials, or other submissions, you retain your rights in your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, analyze, process, moderate, remove, display, and create outputs from it to operate, protect, provide, and improve the Services. You represent that you have the rights to submit such content.
FactHub does not tolerate objectionable content or abusive users. You may not submit User Content that is unlawful, hateful, abusive, harassing, threatening, bullying, sexually explicit, exploitative, violent, spam, scam, misleading, infringing, invasive of privacy, or otherwise harmful to other users or the Services.
9) Content Moderation, Reporting & Blocking
If the Services include community or user-generated areas, users may report comments or other User Content and may block users where those tools are available. Reports help us review potentially harmful or rule-breaking content.
We may review reports, hide or remove content, limit distribution, disable community features, suspend or terminate accounts, decline or remove submissions, or take other action when we believe content or behavior violates these Terms, applicable laws, platform rules, safety standards, or the integrity of the Services. We may also use automated systems, human review, or a combination of both to detect and moderate content.
Blocking another user means you may no longer see that user’s comments or replies in supported areas. Blocking does not guarantee that all prior references, cached content, copied content, or screenshots will disappear immediately.
10) Intellectual Property
The Services, including text, design, logos, software, systems, workflows, models, prompts, user interfaces, report formats, analysis structures, scoring methods, signal taxonomies, datasets, and other materials, are owned by Three Point Zero or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Services unless we give you written permission.
Subject to your compliance with these Terms and payment of any applicable fees, you may use reports or outputs delivered to you for your internal business, research, or decision-support purposes, unless a separate written agreement says otherwise. You may not resell, sublicense, publish, misrepresent, or use FactHub reports or outputs to build a competing product or service without our written permission.
11) Third-Party Content and Links
The Services may display, summarize, link to, or analyze third-party content, including news, public statements, websites, social content, market information, or other materials. Third-party content belongs to its respective owners. We do not control and are not responsible for third-party content, availability, accuracy, policies, or practices.
12) Disclaimers
THE SERVICES, INCLUDING ANY REPORTS, OUTPUTS, SIGNALS, SUMMARIES, ANALYSES, SCORES, RECOMMENDATIONS, CLASSIFICATIONS, PUBLIC-REACTION DATA, BUSINESS INTELLIGENCE, DECISION INTELLIGENCE, OR AI-GENERATED CONTENT, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THREE POINT ZERO INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, REPUTATION, CUSTOMERS, USERS, MARKET VALUE, CAMPAIGN PERFORMANCE, INVESTMENT VALUE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
THIS LIMITATION APPLIES TO CLAIMS ARISING FROM OR RELATED TO REPORTS, DECISION INTELLIGENCE, PUBLIC-REACTION SIGNALS, AI OUTPUTS, PRODUCT TESTING, CAMPAIGN TESTING, MARKET TESTING, USER CONTENT, THIRD-PARTY CONTENT, PLATFORM AVAILABILITY, OR DECISIONS YOU MAKE USING THE SERVICES.
IN ANY EVENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted.
14) Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services, other users, platform integrity, data integrity, our business, or third parties.
15) Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes, we will provide notice by updating the Effective Date and/or through the Services. Continued use after changes means you accept the updated Terms.
